Motor vehicle accidents
New York is a no-fault state, so the threshold question in almost every vehicle case is whether the injury is serious within the meaning of Insurance Law §5102(d). That determines whether a claim exists beyond no-fault benefits at all.

Construction accidents
New York gives construction workers protections that exist in almost no other state. Labor Law §240 imposes absolute liability on owners and general contractors for elevation-related injuries, and §241(6) ties liability to specific Industrial Code rules. A workers’ compensation claim does not replace either.

Slip, trip and fall — premises liability
A property owner is not liable simply because someone fell. The case turns on notice: whether the owner created the condition, or knew about it, or it existed long enough that they should have. Where the property is municipal, a notice of claim within 90 days applies under General Municipal Law §50-e.
Medical malpractice
Malpractice is not a bad outcome; it is care that fell below the accepted standard and caused harm. The limitations period is shorter than for ordinary negligence — generally two years and six months under CPLR §214-a — and each claim requires expert support.

Wrongful death
A wrongful death action can only be brought by a personal representative appointed by Surrogate’s Court, and New York compensates pecuniary loss rather than grief. The deadline is two years from the date of death.

Appeals
Not every case ends at the verdict. We handle appellate work, including before the New York Court of Appeals.
Traffic tickets
A separate practice from injury work, and a separate court system: the Traffic Violations Bureau does not permit plea bargaining, while village and town justice courts do. We do not handle DWI, DUI or commercial driver licensing matters.
